Lawyers in Da Nang

Lawyers practicing Law in Da Nang must have a Law Practicing Certificate, register to join the Bar Association of Da Nang city and be granted a Lawyer's Card by the Vietnam Bar Federation at the request of the Bar Association of Da Nang city ?

Lawyers:

A lawyer is a person who meets the standards and conditions to practice according to the provisions of the Law on Lawyers, performing legal services at the request of clients who are individuals, agencies, and organizations (Article 2 of the Law on Lawyers No. 65/2006/QH11 dated June 29, 2006).

Standards for lawyers:

Vietnamese citizens, who are loyal to the Fatherland, comply with the Constitution and laws, have good moral qualities, have a bachelor's degree in law, have been trained in the Profession of Lawyers, and have passed the probationary period to practice law, and are healthy enough to practice law, can become a lawyer (Article 10, Law on Lawyers No. 65/2006/QH11 dated June 29, 2006).

Conditions for practicing:

A person who meets the standards prescribed in Article 10 of the Law on Lawyers and wants to practice law must have a Law Practicing Certificate and join a Bar Association (Article 11, Law on Lawyers No. 65/2006/QH11 dated June 29, 2006).

Joining a Bar Association:

A person with a Law Practicing Certificate may join a Bar Association of his or her choice to practice law.

A person with a Law Practicing Certificate may send his or her application to join a Bar Association to the Bar Association's Executive Board. An application dossier to join the Bar Association includes:

- Registration form to join the Bar Association;

- Curriculum vitae;

- Copy of the Law Practicing Certificate;

- Judicial record card;

- Health certificate.

Within ten working days from the date of receipt of a complete application dossier to join the Bar Association, the Executive Board of the Bar Association will consider and decide on joining the Bar Association; if the applicant to join the Bar Association falls into one of the cases specified in Clause 4, Article 17 of the Law on Lawyers, the Executive Board of the Bar Association will refuse the application and notify the reason in writing. The rejected person has the right to complain according to the provisions of Article 87 of the Law on Lawyers.

A person who joins the Bar Association is granted a Lawyer Card by the national lawyers' organization upon the request of the Bar Association. The time limit for issuing a lawyer card is no more than thirty days from the date of joining the Bar Association.

A lawyer who moves from one Bar Association to another must go through procedures to withdraw his or her name from the list of lawyers of the Bar Association of which he or she is currently a member in order to transfer his or her activities to the new Bar Association and have his or her lawyer card changed (Article 20, Law on Lawyers No. 65/2006/QH11 dated June 29, 2006).

Forms of lawyer practice:

- Practicing in a law practice organization.

Practicing in a law practice organization is carried out by:

 + Establishing or participating in the establishment of a law practice organization;

 + Working under a contract for a law practice organization.

- Practice as an individual.

Lawyers may choose one of the two forms of practice specified in Clauses 1 and 2 of this Article to practice (Article 23, Law on Lawyers No. 65/2006/QH11 dated June 29, 2006).

Lawyers in Da Nang:

Therefore, according to the provisions of the Law on Lawyers, Lawyers practicing Law in Da Nang must have a Law Practicing Certificate, register to join the Bar Association of Da Nang city, and be granted a Lawyer card by the Vietnam Bar Federation at the request of the Bar Association of Da Nang city and have the right to choose one of two forms of practice: practicing in a law practice organization by establishing or participating in the establishment of a law practice organization or working under a contract for a law practice organization, or practicing as an individual./.
