Law Firm in Da Nang

An organization practicing law in the form of a Law Firm in Da Nang, Vietnam must register its operations at the Department of Justice of Da Nang city, where the Bar Association of Da Nang city is located, of which the Director of the Law Firm in Da Nang is a member ?

Forms of organization of law practice:

Law practice organizations, including:

- A law office;

- A law company.

Law practice organizations are organized and operate according to the provisions of the Law on Lawyers and other relevant laws.

A lawyer may only establish or participate in the establishment of a law practice organization in the locality where the Bar Association of which that lawyer is a member is located. In cases where lawyers from different Bar Associations join together to establish a law firm, they can choose to establish and register to operate in the locality where there is a Bar Association of which one of those lawyers is a member (Article 32, Law on Lawyers No. 65/2006/QH11 dated June 29, 2006).

Law firms:

Law firms include partnership law firms and limited liability law firms. Members of the law firm must be lawyers.

A partnership law firm established by at least two lawyers. A partnership law firm does not have capital contributing members.

Limited liability law firms include limited liability law firms with two or more members and one-member limited liability law firms.

- A limited liability law firm with two or more members established by at least two lawyers.

- A one-member limited liability law firm established and owned by a lawyer.

Members of a partnership law firm or limited liability law firm with two or more members agree to appoint one member to be the company's Director. The lawyer who owns a one-member limited liability law firm is the company's director.

The name of a partnership law firm, a limited liability law firm with two or more members is chosen by agreement of the members, the name of a one-member limited liability law firm is chosen by the owner and according to provisions of the Law on Enterprises but must include the phrase "partnership law firm" or "limited liability law firm" and must not be identical or confusing with the name of another registered law practice organization, must not use words or symbols that violate the historical, cultural, or ethical traditions and fine customs of the nation (Article 34, Law on Lawyers No. 65/2006/QH11 dated June 29, 2006 ).

Registering the operation of a law practice organization:

Law practice organizations register their operations at the Department of Justice in the locality where the Bar Association of which the Head of the Law Office or Director of the Law Firm is a member is located. A Law firm jointly established by lawyers from different Bar Associations must register their operations at the Department of Justice in the locality where the company's headquarters is located (Clause 1, Article 35 of the Law on Lawyers No. 65/2006/ QH11 dated June 29, 2006).

Therefore, according to the provisions of the Law on Lawyers, organizations practicing law in the form of Law Firms in Da Nang include partnership law firms and limited liability law firms.
