Hi DMS Law office in Vietnam! We are foreign spouses looking to adopt a Vietnamese child. Could you advise me about the requirement for appraisal of foreign adopter’s documents ?

Requirements for appraisal of the foreign adopter’s dossier

Examination of dossier for Vietnamese child adoption by overseas Vietnamese, foreigners who permanently reside in a foreign country is carried out in accordance with provisions in Clause 1 Article 34 of the Law on Adoption No. 52/2010/QH12 dated June 17, 2010 and the following specific provisions:

After receiving complete dossier of the adopter, the Department of Child Adoption shall consider and appraise the dossier to determine:

The adopter has been ensured by the competent agencies of the country of his/her permanent residence that he/she meets sufficient conditions for child adoption according to such country’s law;

The adopter meets sufficient conditions for adoption under regulations of Vietnamese laws.

When appraising the dossier, if necessary, the Department of Child Adoption shall collect ideas of experts of psychology, health, family, society in order to determine that adopter has the best conditions to care for, nurture and educate the adoptee.

Dossier of the adopter is approved if meeting the requirements in Clauses 1 and 2 of this Article; in case of disapproval, the Department of Child Adoption shall return the dossier to the adopter and state clearly reasons in writing form (Article 18 Decree No 19/2011/ND-CP dated March 21, 2011).
