Wage in probationary period in Vietnam

Hi DMS Lawyers in Vietnam! I am an expat living in Danang Vietnam. I am negotiating a labor contract with a Vietnamese employer. My job offer includes 02-month probation with 85% of gross salary. Can a company make a job offer, sign a labor contract subject to successful completion of a probationary period ? Can you advise me about probationary period ?

Probation period

The probation period shall be based on the nature and complexity of the job but probation is applied only once for each job and ensure the following conditions:

Not exceed 60 days for jobs which require professional and technical qualification of college education or higher level.

Not exceed 30 days for jobs which require professional and technical qualifications of intermediate vocational education, professional workers, technical workers and skilled employees.

Not exceed 06 working days for other jobs.

Wage during the probation period:

The wage for an employee during the probation period is agreed by both parties but must be at least equal to 85% of the wage for the job.

Expiry of the probation period:   

If the probation is passed, the employer must sign a labor contract with the employee.

During the probation period, each party is entitled to cancel the probation agreement without prior notice and without compensation if the probation fails to satisfy the requirements agreed by both parties (Articles 27, 28, 29 the Labor Code No. 52/VBHN-VPQH dated December 10, 2018).
