Hi DMS Attorney in Vietnam! Could you advise me about public holidays and Tet leave in Vietnam ? How about holidays applicable to foreign employees in Vietnam ? Thank you!

Holiday and Tet leave

An employee shall be entitled to have days off fully paid on the following public holidays: 

Calendar New Year Holiday: 01 day (the first day of January of each calendar year);

Lunar New Year Holidays: 05 days;

Victory Day: 01 day (the 30th of April of each calendar year);

International Labor Day: 01 day (the first day of May of each calendar year); 

National Day: 01 day (the second day of September of each calendar year);

Commemorative Celebration of Vietnam’s Forefather - Hung Kings: 01 day (the 10th of March of each Lunar year).

The employees who are foreign citizens working in Vietnam, besides the holidays as prescribed in Clause 1 of this Article, they are also entitled to an additional day of traditional new year holiday and 01 day of their country's National Day.

Where the public holidays as prescribed in Clause 1 of this Article coincide with a weekly days-off, the employee shall be entitled to take the succeeding compensatory days-off instead (Article 115 the Labour Code No. 52/VBHN-VPQH dated December 10, 2018).
