Hi DMS Lawyer in Vietnam! Can you advise me about overtime pay in Vietnam ? Who is entitled to overtime pay? What is the overtime pay rate ? What is the pay rate for working at night ? Thank you!

Pay for overtime and working at night:

An employee who works overtime shall be paid according to the wage per unit of time or per unit of output (hereinafter called “wage rate”) or the wage for his/her current job as follows:

On normal weekdays, at least equal to 150%;

On weekly days-off, weekends at least equal to 200%;

On public holidays and paid leave days, at least equal to 300%, excluding the wage for public holidays and paid leave days of employees who receive daily wages.

An employee who works at night shall be paid an additional amount at least equal to 30% of the wage calculated by the wage rate or the wage for the job done under a normal working day.

An employee who works overtime at night, in addition to the wage as prescribed in Clause 1 and Clause 2 of this Article, the employee shall also be paid an extra 20% of wage calculated by the wage rate or the wage for a job done in the day time (Article 97 the Labor Code No. 52/VBHN-VPQH dated December 10, 2018).
