Open a branch of an overseas company in Da Nang, Vietnam ?

Foreign companies are entitled to open a branch in Vietnam in accordance with commitments of Vietnam in international treaties to which Vietnam is a member.

Conditions on issuance of License for establishment of branches:

Foreign traders shall be granted License for establishment of branches in Vietnam if they meet the following conditions:

The foreign trader has been registered according to the law of a country, territory participating in international treaties to which Vietnam is a member or being recognized by the law of these countries or territories.

The foreign trader has operated for 05 years or more since legal establishment or valid business registration;

If business registration certificate or equal documents of the foreign trader states the expiration date, that validity of that time should remain at least one year since the submission of the dossier;

The operation of branches must be in accordance with commitments of Vietnam on market access in international treaties to which Vietnam is a member and be in accordance with business scope of the foreign trader;

If the operation of branches is not accordance with commitments of Vietnam or the foreign traders are not from countries, territories participating international treaties to which Vietnam is a member, the establishment of branches must be approved by the Minister of specialized management) (Article 8 Decree No. 07/2016/NĐ-CP dated January 25, 2016 detailing the Commercial law on Representative office,   Branch of foreign trader in Vietnam)./.
