Fulfillment of tax liability before exiting Vietnam

I am the legal representative of a foreign invested company in Da Nang, Vietnam. Could you advise me about responsibility to settle tax before leaving Vietnam ?

Today, July 01, 2020, the Law on Tax Administration No. 38/2019/QH14, dated June 13, 2019 comes into effect. The law provides responsibility of entities to settle tax before leaving Vietnam as excerpted below:

Fulfillment of tax liability before exiting Vietnam

The taxpayer against whom tax administrative decisions are enforced, Vietnamese citizens exiting Vietnam to reside overseas, Vietnamese people residing overseas, foreigners exiting Vietnam must fulfill their tax liability before the exit. Otherwise, they shall be suspended from exit in accordance with the law on entry, exit.

Legal representatives of the taxpayers must fulfilled tax liabilities of the enterprise subjected to enforcement following tax administrative decisions before leaving Vietnam and the exit from Vietnam may be suspended according to the law on entry, exit (Clause 1 Article 66 Clause 7 Article 124 Law on Tax Administration No. 38/2019/QH14, dated June 13, 2019).
