Obligation to pay first-instance civil court fee advances

The plaintiffs, the defendants who have counterclaims, persons with related rights or obligations who have independent request in a civil, marriage and family, commercial or labor dispute case must pay advance for first-instance court fee, except for those who are not required to pay or are exempted from paying court fee advance in accordance with provisions of this Resolution (Clause 1 Article 25 Resolution No. 326/2016/UBTVQH14 dated 30 December 2016).

Obligation to bear first-instance civil court fees

The involved parties must bear the first-instance Court fees if their petitions are not accepted by courts, except for cases where they are exempted from, or are not required to pay such fees.

Defendants must bear all first-instance civil court fees in case plaintiffs' claims are wholly accepted by courts.

Plaintiffs must bear all first-instance civil court fees in case all their claims are wholly unaccepted by courts (Clauses 1, 2 and 3 Article 26 Resolution No. 326/2016/UBTVQH14 dated 30 December 2016).
