How to register for acknowledgement of paternity in Vietnam ?

Hi DMS Law office in Vietnam! If the parents of a child are not married to each other, a child born to unmarried parents, how to register for acknowledgement of paternity in Vietnam ? How to prove a father-child relationship ? How to establish the child’s legal father ? Could you advise me how to register a birth and acknowledgement of parenthood ?

In case a person requests registration for acknowledgement of parenthood while registering a child birth, the civil status registration agencies shall concurrently settle procedures for birth registration and registration for parent-child acknowledgement, as follows:

Dossier for birth registration and registration for parent-child acknowledgement:

Birth registration form and Registration form for parent-child acknowledgement as prescribed; Birth certificate or substitute of Birth Certificate mentioned in Clause 1 Article 16 Law on Civil Status; Proof of parent-child relationship mentioned in Article 11 of this Circular (Clause 1 Article 12 Circular No. 15/2015/TT-BTP dated 11/16/2015).

Other documents, order for settlement shall be implemented in accordance with provisions in Clauses 1 and 2 Article 16 and Article 25 of the Law on Civil Status in case falling within the competence of Commune-level People’s Committee; in accordance with provisions of Clauses 1 and 2 Article 36 and Article 44 of the Law on Civil Status in case falling within the competence of District-level People’s  Committee (Clause 2 Article 12 Circular No. 15/2015/TT-BTP dated 11/16/2015).

According to provisions in Article 11 Circular No. 15/2015/TT-BTP dated 11/16/2015, proof of parent-child relationship prescribed in Clause 1 Article 25 and Clause 1 Article 44 of the Law on Civil Status includes any of the following papers, documents: documents of a medical agency, inspection agency or other domestic or foreign competent agencies certifying parent-child relationship.

If none of the documents mentioned in Clause 1 of this Article apply, there must be letters, films, pictures, CDs, utensils or other tools proving parent-child relationship and the affidavit of parents about their common child which is witnessed by at least two relatives of the parents./.
