Hi DMS Law office in Vietnam! We are overseas Vietnamese spouses looking to adopt a Vietnamese child. Could you advise me about procedure for submission of Vietnamese child adoption application ?

Procedure for submission of Vietnamese Child Adoption Application

Procedure for submission and reception of application for Vietnamese child adoption by overseas Vietnamese, foreigners who permanently reside in a foreign country is carried out according to provisions in Clause 3 Article 31 of the Law on Adoption No 52/2010/QH12 dated June 17, 2010 and the following specific provisions:

In case of adoption of a specific child (Notional Request), the adopter shall directly submit the application to the Department of Child Adoption. If having appropriate reason for not being able to directly submit the application to the Department of Child Adoption, the adopter may authorize in writing to their relatives who permanently reside in Vietnam to submit the application to the Department of Child Adoption or send by registered post service.

In case of non-specific child adoption (Non-Notional Request), the adopter who permanently resides in a member country in international convention on child adoption, to which Viet Nam also belongs, shall submit the application to the Department of Child Adoption through such country adoption agencies granted license for operating in Vietnam; if such country does not have an adoption agency in Vietnam, the adopter shall submit the application to the Department of Child Adoption through the diplomatic representative agencies or the Consular agency of such country in Vietnam.

The Department of Child Adoption shall consider, receive the application based on the number of Vietnamese children satisfying conditions for intercountry adoption (Article 17 Decree No 19/2011/ND-CP dated March 21, 2011).
