Hi DMS Law firm in Vietnam! Im am preparing to conduct promotion activities, register trade fairs and exhibitions in Vietnam for my company. Can you advise me on how to register  trade fairs and exhibitions in Vietnam ?

Trade fairs and exhibitions mean commercial promotion activities conducted in a concentrated manner at particular locations and for given periods of time for traders to display and introduce their goods and/or services for the purpose of promoting them and seeking opportunities for entering into contracts for sale and purchase of goods or service contracts (Article 129 The commercial law No. 36/2005/QH11 dated June 14, 2005).

Trade fairs and exhibitions organized in Vietnam must be registered with and certified in writing by the state management agencies in charge of commerce of the provinces or centrally-run cities where such trade fairs and exhibitions are to be organized (Clause 1 Article 132 The commercial law No. 36/2005/QH11 dated June 14, 2005).

Goods and/or services which are not permitted for participation in trade fairs and exhibitions include: Goods and/or services banned from business, subject to business restrictions, or not yet permitted for circulation according to the provisions of law; Goods and/or services provided by overseas traders and banned from import according to the provisions of law; Counterfeit goods and goods infringing upon intellectual property rights, except where they are displayed and introduced for comparison with genuine ones (Clause 1 Article 134 The commercial law No. 36/2005/QH11 dated June 14, 2005).

Goods to be displayed or introduced at trade fairs and exhibitions in Vietnam must be labeled according to the provisions of law on goods labeling (Clause 1 Article 29 Decree No. 37/2006/NĐ-CP dated April 04, 2006).

The display of counterfeit goods and intellectual property right-infringing goods for comparison with genuine goods must be approved by the state management agencies in charge of commerce according to the provisions of law (Clause 1 Điều 30 Decree No. 37/2006/NĐ-CP dated April 04, 2006).

A dossier of registration for organization of a trade fair or exhibition, includes: A written registration for organization of a trade fair or exhibition, made according to a form set by the Trade Ministry. Contents to be registered for organization of a trade fair or exhibition, include: names and addresses of traders or organizations engaged in commerce-related activities that organize the trade fair or exhibition; the name and theme of the trade fair or exhibition (if any); the time and venue of the trade fair or exhibition; the intended scope of the trade fair or exhibition; A copy of the business-investment registration certificate, the establishment decision or another decision of equivalent legal validity as provided for by law; Evidences proving that the quality and titles of goods or services or the reputation or titles of traders, organizations or individuals participating in the trade fair or exhibition are compatible with the name and theme of such trade fair or exhibition (Article 38 Decree No. 37/2006/NĐ-CP dated April 04, 2006).

Dosier of registration for organization of a trade fair or exhibition shall be performed in accordance with provisions of Article 38 Decree No. 37/2006/NĐ-CP, in which the application form for organization of a trade fair or exhibition shall be made according to form HCTL-1 Annex attached to this Circular (Clause 2 part III Join Circular No. 07/2007/TTLT-BTM-BTC dated July 06, 2007).
