Hello DMS Law firm in Da Nang, Vietnam! What is the procedure to register for organization of trade fairs and exhibitions in DaNang ? How about the sequence, procedure, dossier to apply for organization of trade fairs and exhibitions for traders in DaNang ?

Trade fairs and exhibitions mean commercial promotion activities conducted in a concentrated manner at particular locations and for given periods of time for traders to display and introduce their goods and/or services for the purpose of promoting them and seeking opportunities for entering into contracts for sale and purchase of goods or service contracts (Article 129 The commercial law No. 36/2005/QH11 dated June 14, 2005).

Trade fairs and exhibitions organized in Vietnam must be registered with and certified in writing by the state management agencies in charge of commerce of the provinces or centrally-run cities where such trade fairs and exhibitions are to be organized (Clause 1 Article 132 The commercial law No. 36/2005/QH11 dated June 14, 2005).

Traders who organize trade fairs and exhibitions in Vietnam (except for trade fairs and exhibitions in the framework of programmes, trade promotion activities decided by the Prime Minister, provincial People’s Committee) or organize for traders, organizations, people participating in trade fairs and exhibitions abroad (except for trade fairs and exhibitions in the framework of programmes, trade promotion activities decided by the Prime Minister) must register to organize the trade fairs and exhibitions at the competent state management agency.

Competent state management agency in Vietnam in charge of commerce, include:

Provincial/ municipal Industry and Trade Services of localities where such trade fairs and exhibitions are to be conducted;

The Ministry of Industry and Trade where trade fairs and exhibitions are to be conducted overseas.

Time for registration of a trade fair and exhibition in Vietnam:

Maximum 365 (earliest) days and minimum 30 days (latest) prior to a trade fair or exhibition which is to be conducted in Vietnam;

Maximum 365 (earliest) days and minimum 45 days (latest) prior to a trade fair or exhibition which is to be conducted overseas;

Dossier for registration to organize trade fairs and exhibitions, includes:

A registration form for organization of a trade fair or exhibition, according to form No. 10 promulgated together with this Decree;

01 copy (not need to be authenticated) of the Enterprise registration certificate, Certificate of Investment Registration, Establishment decision or other decisions with equal validity according to law (Article 29 Decree No. 81/2018/NĐ-CP dated May 22, 2018).
