Conditions for investors in commercial housing projects

Must be enterprises or cooperatives established and operated under Vietnamese regulations of law.

Have sufficient legal capital as prescribed in law on real estate trading and have deposited capital for every project as prescribed in law on investment.

Be licensed for real estate trading as prescribed by law.

Investment projects for commercial housing construction and investor selection

Investment projects for commercial housing construction must be formulated, assessed, approved and executed as prescribed in regulations of this Law and law on construction.

The investors in projects for commercial housing construction shall be selected through the following methods:

Holding land auction prescribed in law on land;

Inviting bids for land-using projects;

Appointing investors who meet all requirements prescribed in Article 21 of this Law or having lawful land use rights as prescribed in Clause 1 and Clause 4 of Article 23 of this Law.

The housing authorities of provinces shall report the selection of investors in the projects for commercial housing construction to the People’s Committee of the province for decision; in case the project is a large-scale project and relates to multiple provinces as prescribed in regulations of the Government, the housing authority of each province shall report it to the competent agency prescribed in Clause 2 Article 170 of this Law before selecting the investors (Articles 21, 22 Law on Housing No. 65/2014/QH13 dated 11/25/2014).
