Notarization of real estate contracts or transactions in Vietnam

Hi DMS Lawyer in Vietnam! Can the notarization of purchase agreement of an apartment located in HCMC be carried out at a Notary office in Hanoi ?

Scope of notarization of real estate contracts or transactions:

Notaries of a notarial practice organization may only notarize contracts and transactions related to real estate within the province or centrally run city where the notarial practice organization is located, excluding testaments or written disclaimers of inheritance of property and letters of authorization related to the exercise of real estate-related rights (Article 42 Law on Notarization  No. 53/2014/QH13 dated 20 June 2014)

Therefore, the notarization of an agreement for sale of a property located in HCMC shall be carried out by a Notary Public in HCMC. Notaries of a Notary office in Hanoi are not permitted to notarize agreements, transactions of property located in HCMC.
