Transfer of off-the-plan building sale or lease purchase agreement
Hi DMS Lawyer in Vietnam! Could you advise me if the purchaser in an off-the-plan building lease purchase agreement can transfer such agreement to other buyer ?

Transfer of off-the-plan building sale or lease purchase agreement:
The purchaser may transfer the off-the-plan building sale or lease purchase agreement if the application for the Certificate of land use rights, ownership of house and other property attached to the land granted to purchaser has been not sent to competent state agencies. The transfer of off-the-plan building sale or lease purchase agreement must be made in writing and certified by the developer.
The transferee may retain rights and obligations of the purchaser. The developer must enable contracting parties to transfer the agreement and must not collect any remuneration related to the transfer.
The last transferee shall be granted the Certificate land use rights, ownership of house and other property attached to land as prescribed in law on land (Clauses 1, 2, 3 Article 59 Law on Real Estate Trading No. 66/2014/QH13 dated 11/25/2014).
