Change your last name after marriage ?

Hi DMS Law office in Vietnam! I married to a US citizen and living in the US. My personal documents in the US have been changed into my husband’s last name for convenience in daily life, except my Vietnamese passport is still using my Vietnamese’s name. Could you advise me if I can change the name in my Vietnamese passport into my husband’s last name ?

In order to change the name on your Vietnamese passport, you have to carry out procedures to change your name in accordance with the Civil Code. Right of a person to change name in case of marriage and family relations involving foreign elements is prescribed in the Civil Code, as follows:

Right to change family names

An individual has the right to request a competent authority to recognize the change of a family name of a person to his/her spouse’s in the marriage and family relations involving foreign elements in accordance with law of the country in which the foreign spouse is a citizen or retrieves his/her family name before the change. The changing of a family name shall not change or terminate the civil rights and obligations which were established in the former family name (Point e Clause 1, Clause 3 Article 27 The Civil Code No.91/2015/QH13 dated  November 24, 2015).

Right to change given names

An individual has the right to request a competent authority to recognize the change of a given name of a person to his/her spouse’s in the marriage and family relations involving foreign elements in accordance with law of the country in which the foreign spouse is a citizen retrieves his/her family name before the change. The changing of a given name shall not change or terminate the civil rights and obligations which were established in the former given name (Point e Clause 1, Clause 3 Article 28The Civil Code No.91/2015/QH13 dated  November 24, 2015).
