How to declare origin of exported products ?

Hi DMS Law firm in Vietnam! My company has imported materials for product manufacturing and is exporting scrap, i.e. recyclable materials left over from product manufacturing in Vietnam. Can you advise me if my company has to declare the origin of the exported scrap is Vietnam or the foreign country which is the origin of the imported materials ?

Origin of goods:

Origin of goods means a country or a territory where all the goods are turned out or where the last stage of substantial processing of goods is performed in cases where many countries or territories join in the process of producing such goods (Clause 14 Article 3 the Commercial Law No. 17/VBHN-VPQH dated 05 July 2019).

Verification of origin of exported goods

Customs authorities shall verify the origin of exported goods based on the verification of customs declaration and documentary evidence in customs documents and results of physical inspection of goods;

If case of doubt about the origin of exported goods, customs authorities shall request customs declarants to provide documents related to the origin of exported goods, and verify the origin of goods at production facilitates. While awaiting the results of verification of origin of goods, the exported goods may be granted clearance as prescribed in Article 37 of this Law (Clause 1 Article 27 Law on Customs No.54/2014/QH13 dated 23 June 2014).

Therefore, the scrap is left over from product manufacturing in Vietnam, your company has to declare origin of the scrap is Vietnam. The customs office shall verify the origin of exported products according to provisions in Clause 1 Article 27 Law on Customs No.54/2014/QH13 dated 23 June 2014.
