Housing management authorization in Vietnam

Hi DMS Attorney in Vietnam! I own a rental apartment but don't have time to manage it. I want to authorize someone else to manage my property. Can I use a power of attorney to give other person the authority to handle my rental property ?

You can use an authorization agreement to allow other person (the agent) to represent you (the principal) in managing your apartment. The content, scope of such an authorization is prescribed by law, see below.

Content, scope of housing management authorization:

Housing management authorization means the homeowner authorizes other organization or individual to exercise rights and fulfill obligations of the homeowner pertaining to management and use of housing over the duration of authorization. The housing management authorization is only applicable to existing houses.

Content, scope of housing management authorization shall be agreed by contracting parties and stated in the authorization agreement; if the contracting parties do not agree about the duration of authorization, the authorization agreement shall take effect for one year, from the day on which the authorization agreement is concluded.

The authorizer must pay the administrative expense, unless otherwise agreed (Article 155 Law on Housing No. 65/2014/QH13 dated 11/25/2014).
