Grounds for determination that a person has Vietnamese nationality:

A person is determined having Vietnamese nationality, if there is one of the following grounds:

By birth, according to the provisions of the Law on Vietnamese nationality, such as:

A child born inside or outside the Vietnamese territory whose parents, at the time of his/her birth, are both Vietnamese citizens, has Vietnamese nationality.

A child born within or outside the Vietnamese territory whose father or mother, at the time of his/her birth, is a Vietnamese citizen and the other is stateless, or whose mother is a Vietnamese citizen and whose father is unknown, has Vietnamese nationality.

A child whose father or mother, at the time of his/her birth, is a Vietnamese citizen and the other is a foreign citizen, has Vietnamese nationality, if there is a written agreement of the parents at the time of birth registration for the child. In cases where a child is born in the Vietnamese territory but his/her parents fail to reach an agreement on the selection of his/her nationality, such child has Vietnamese nationality.

Be permitted Vietnamese naturalization;

Be permitted to restore Vietnamese nationality;

According to international treaties to which the Socialist Republic of Vietnam is a member.
