Eligibility of overseas Vietnamese to own house in Vietnam

Hi DMS Law office in Vietnam! I am an overseas Vietnamese. Can you advise me the requirements for an overseas Vietnamese to be eligible to own a house in Vietnam ?

Documents proving eligibility of overseas Vietnamese to own house in Vietnam:

A valid Vietnamese passport that bears the entry seal of a Vietnam’s immigration authority; or A valid foreign passport that bears the entry seal of a Vietnam’s immigration authority together with documents proving the Vietnamese nationality or Vietnamese origin issued by the Department of Justice of a province, centrally-run city, an overseas Vietnam’s diplomatic mission, or an authority in charge of management of overseas Vietnamese citizens, or other documents prescribed by Vietnam’s law.

Issuance of Certificate to house owner:

Domestic organizations, households, individuals, overseas Vietnamese , foreign organizations and individuals that have documents proving the lawful establishment of houses as prescribed by the Law on Housing, regulations of law on real estate trading, and relevant regulations of law (including housing invested under construction planning approved by competent authorities in the projects mentioned in Clause 2 Article 17 of the Law on Housing), and documents proving their eligibility to own houses prescribed in Article 5 of this Decree shall be granted the Certificate of ownership of such house.

If an overseas Vietnamese (Viet Kieu) is not allowed to enter Vietnam but has been gifted or inherited a house in Vietnam, he/she will not be recognized house ownership and has to follow the regulations in Clauses 2, 3,4 and 5 Article 78 of this Decree (Articles 5, 6 Decree No. 99/2015/ND-CP dated 20 October 2015).
