Court fees in civil and family disputes in Vietnam

Hi DMS Law firm in Vietnam! My company is planning to sue a debtor for an overdue payment of 2.5 billion Dong. Can you advise me about the court fee in a civil court case ? How much we have to pay for court fees in civil disputes ?

Court fees in civil and family disputes - Courts of first instance

The fee for a court of first instance in Civil, Marriage and Family disputes that have price levels from above 2 billion Dong to 4 billion Dong is 72 million Dong plus 2% of the value in excess of 2 billion Dong of the property in dispute (Point 1.3 d, Clause 1, Section II List of Court fees, promulgated together with the Resolution No. 326/2016/UBTVQH14 dated 30 December 2016).

Collection of court fee advances, charge advances

The advance of court fee in a first instance court of a civil case involving no price level equals to such court fee. The advance of court fee in a first instance court in a civil case involving price levels equals to 50% of the court fee which is estimated by the Court according to the value of the property in dispute to be settled at the request of involved parties but at least it shall not be lower than the court fee in a first instance court of a civil case involving no price level (Clause 2 Article 7 the Resolution No. 326/2016/UBTVQH14 dated 30 December 2016).

Therefore, if your company is making a lawsuit to request the Court to settle a civil dispute involving an overdue debt of 2.5 billion Dong, the court fee advance is calculated as (72,000,000 + 2% x 500,000,000) x 50% = 41,000,000 Dong.
