Conditions for birth re-registration involving foreign elements:

Any birth, marriage, or death registration of an overseas Vietnamese or a foreigner that has been registered at competent agencies of Vietnam before January 01, 2016 but the Vital records and the original of civil status documents are lost shall be eligible for re-registration.

The birth or marriage re-registration is only implemented if the applicants are still alive at the time of re-registration request (Article 40 Decree No. 123/2015/ND-CP dated 15 November 2015).

Competence for birth re-registration involving foreign elements:

The district-level People’s Committee which issued the former birth, marriage or death registration shall have the competence for birth, marriage or death re-registration.

If the former birth, marriage or death registration was issued by a Commune-level People’s Committee, the birth, marriage or death re-registration shall be implemented by its superior District-level People’s Committee.

If the former birth, marriage or death registration was issued by the Provincial-level People’s Committee or Department of Justice, the birth, marriage or death re-registration shall be implemented by the People’s Committee of district where the applicant resides; if such applicant does not reside in Vietnam, the birth, marriage or death re-registration shall be implemented by the People’s Committee of district where the Department of Justice is headquartered (Article 42 Decree No. 123/2015/ND-CP dated 15 November 2015).
