Authentication of signatures on papers written in foreign language in Vietnam

Hi DMS Attorney in Vietnam! I am a foreigner travelling in Vietnam. I need to authenticate my signature on a private document written in foreign language in order to use such document in another country. How can a notary witness my signature on an affidavit or a power of attorney for use in a foreign jurisdiction ? Could you advise me how to do this in Vietnam ?

Authentication of signatures on documents written in a foreign language in Vietnam:

When authenticate the signature on papers, documents written in foreign language, if the authenticating person does not clearly understand the content of such papers, documents, the authenticating person shall require the requester for authentication to submit a translation into Vietnamese attached to the documents. The Vietnamese translation is not required to have the translator’s signature notarized or authenticated, but the requester for authentication shall be responsible for the accuracy of the translation (Article 12 Circular No. 01/2020/TT-BTP dated 03/03/2020).

Requesters for authentication of signatures shall present the following papers:

Originals or certified true copies of valid ID card or passport;

Papers, documents to be signed by themselves (Clause 1 Article 24 Decree No. 23/2015/ND-CP dated 16 February 2015).

Authorities for authentication of signatures on documents written in foreign language:

The Justice offices of provincial-affiliated districts and cities or Notaries in Vietnam (Point c Clause 1, Article 5 Decree No. 23/2015/ND-CP dated  16 February 2015).

In conclusion, authentication of signatures means competent agencies shall authenticate signatures on papers, documents as signatures of the person concerned. A paper-based signature can be authenticated at competent agencies if the concerned person proves his/her identity appropriately.
