A stepfather who is an Australian citizen adopts his wife's child under 18 years of age

In cases where a stepfather is an Australian citizen, permanently residing abroad, is he permitted to adopt his wife's child under 18 years of age?

Adoption with foreign elements means the adoption between Vietnamese citizens and foreigners, between foreigners permanently residing in Vietnam, and between Vietnamese citizens in which one party settles abroad.

Cases of adoption with foreign elements:

Overseas Vietnamese and foreigners permanently residing in countries that are members of international treaties on adoption with Vietnam adopt Vietnamese children.

Overseas Vietnamese and foreigners permanently residing abroad are permitted to adopt a child by name in the following cases:

- Be the stepfather or stepmother of the adopted child;

- Be the biological aunt or biological uncle of the adopted child;

- Have an adopted child who is the sibling of the adopted child;

- Adopt children with disabilities, HIV/AIDS or other serious illnesses;

- Be a foreigner working or studying in Vietnam for at least 01 year.

Vietnamese citizens permanently residing in the country adopt foreign children.

Foreigners permanently residing in Vietnam adopting children in Vietnam.

Therefore, in cases where a stepfather is an Australian citizen, permanently residing abroad, he is permitted to adopt his wife's child under 18 years of age.
